1. Overview
This website is operated by Travel Umpire. Throughout this website, the terms “we”, “us” and “our” refer to Travel Umpire. The terms “you”, “your” and “traveller” refer to the person making a booking or participating in a Travel Umpire trip.
Travel Umpire provides tours, treks, travel experiences, activities and related travel services in Nepal.
By visiting our website, submitting a booking request, making a payment or confirming a trip with us, you acknowledge that you have read, understood and agreed to these Booking Terms & Conditions.
These Terms & Conditions apply to all bookings unless different terms have been specifically agreed with you in writing.
2. Booking Confirmation
A booking request does not automatically constitute a confirmed booking.
Your booking will be confirmed once Travel Umpire has received the required payment and has provided confirmation of your booking in writing.
The itinerary, services, inclusions, exclusions, price and payment arrangements applicable to your trip will be confirmed at the time of booking.
3. Standard Trip Booking and Payment
3.1 Deposit
For standard trips and itineraries offered on the Travel Umpire website, a 30% non-refundable deposit is required to confirm your booking.
The deposit may be used to secure accommodation, transportation, permits, guides, activities and other arrangements required for your trip.
3.2 Remaining Balance
The remaining 70% of the total trip price must be paid 15 days before your arrival in Nepal, unless another payment arrangement has been agreed with you in writing.
3.3 Payment Currency
Payments must be made in USD or another currency accepted by Travel Umpire.
Any bank charges, payment-processing fees or currency-conversion costs may be payable by the traveller unless otherwise agreed.
3.4 Failure to Pay
If the remaining balance is not paid as agreed, Travel Umpire reserves the right to suspend or cancel the trip.
In such circumstances, the 30% deposit and any other non-refundable costs already incurred may be retained.
4. Tailor-Made and Customised Trips
4.1 Customised Trips
Travel Umpire may arrange tailor-made or customised trips based on your preferred dates, destinations, activities, accommodation, transportation and other requirements.
4.2 Deposit
A 30% non-refundable deposit, or another amount agreed in writing, is required to confirm a customised trip.
4.3 Balance Payment
Unless otherwise agreed in writing, the remaining balance for a customised trip must be paid 15 days before the start of the trip.
4.4 Customised Trip Costs
Customised trips may involve bookings and arrangements made specifically for you. Cancellation, amendment or supplier charges may therefore apply.
Any applicable charges will depend on the services already booked and the terms of the relevant suppliers.
4.5 Changes to Customised Trips
Changes requested after a customised trip has been confirmed may result in additional costs and are subject to availability.
5. Prices
All prices displayed on the Travel Umpire website are subject to the inclusions and exclusions stated for the relevant trip.
Prices may change before a booking is confirmed due to changes in accommodation, transportation, permits, government fees, supplier costs, exchange rates or other circumstances.
Once your booking has been confirmed, the agreed price will normally apply unless additional costs arise from:
- Changes requested by the traveller;
- Additional services;
- Changes to the itinerary requested by the traveller; or
- Circumstances outside the Travel Umpire’s reasonable control.
6. Cancellation by the Traveller
6.1 Cancellation Notice
If you wish to cancel your trip, you must notify Travel Umpire in writing.
The cancellation date will be the date on which we receive your written cancellation request.
6.2 Cancellation Charges
Unless different cancellation terms have been agreed in writing, the following cancellation charges apply to the total trip price:
- 10 or more days before departure: 50% of the total trip price.
- 5–7 days before departure: 75% of the total trip price.
- 3 days or less before departure: 100% of the total trip price (no refund).
6.3 Cancellations 8–9 Days Before Departure
Cancellations made 8–9 days before departure will be subject to a 75% cancellation charge, unless otherwise agreed in writing.
6.4 Non-Refundable Deposit
The 30% deposit is non-refundable.
Where a cancellation charge is greater than the amount already paid, the traveller may be required to pay the applicable cancellation amount before the cancellation can be considered fully settled.
6.5 Non-Refundable Supplier Costs
Where airlines, hotels, transport providers, activity operators or other suppliers have charged non-refundable fees or cancellation charges, these costs may be deducted from any refund otherwise available.
6.6 No-Show or Early Departure
No refund will normally be provided for:
- Failure to arrive for the trip;
- Arriving late and missing included services;
- Leaving a trip early;
- Choosing not to participate in an included activity; or
- Deciding not to continue a trip after it has started.
This does not affect any rights you may have under applicable law.
7. Cancellation by Travel Umpire
Travel Umpire reserves the right to cancel or substantially change a trip where reasonably necessary due to safety concerns, operational requirements, insufficient arrangements or circumstances beyond our reasonable control.
Where Travel Umpire cancels a trip and cannot provide a reasonable alternative arrangement, we will refund amounts paid for the cancelled services, subject to applicable law and any non-refundable third-party costs that cannot be recovered.
Where cancellation is caused by circumstances beyond our reasonable control, additional compensation may not be available.
8. Travel Insurance
Travel insurance is strongly recommended for all travellers and should cover the entire period from your departure from your home country until your return.
Your travel insurance should provide suitable cover for:
- Trip cancellation or interruption;
- Medical expenses;
- Emergency evacuation;
- Trekking and high-altitude activities;
- Flight delays and cancellations;
- Lost or damaged luggage;
- Personal belongings; and
- Other relevant travel risks.
It is your responsibility to ensure that your insurance policy provides adequate coverage for your particular itinerary and activities.
Travel Umpire is not responsible for costs that could reasonably have been covered by appropriate travel insurance.
9. Passport, Visa and Travel Documents
You are responsible for ensuring that you have:
- A valid passport;
- The appropriate Nepal visa or entry permission;
- Required trekking or travel permits;
- Any required health or vaccination documentation; and
- Any other documents required for your journey.
We recommend obtaining independent professional advice regarding passport, visa, immigration and health requirements where appropriate.
Travel Umpire is not responsible for losses, delays, missed services or additional expenses resulting from expired, incorrect or missing travel documents.
10. Personal Information and Traveller Declarations
When making a booking, you confirm that all information provided to Travel Umpire is true, accurate and complete.
You agree to provide information reasonably required to arrange your trip, including information relating to your travel documents, emergency contact details and relevant health or fitness considerations.
If you provide inaccurate or incomplete information that affects your booking or participation, Travel Umpire may need to make reasonable changes to your arrangements.
You are responsible for obtaining appropriate professional advice regarding your own passport, visa, immigration and health requirements.
11. Health and Fitness
Some Travel Umpire trips involve trekking, hiking, climbing, high-altitude travel, rafting and other physically demanding activities.
You are responsible for ensuring that you are physically and medically suitable for your chosen trip.
If you have a medical condition, allergy, injury, disability or other health concern that may affect your participation, comfort or safety, you should obtain appropriate medical advice before travelling and inform Travel Umpire where relevant.
Some trekking destinations involve high altitude and may carry risks including altitude sickness and other altitude-related conditions.
Travel Umpire may require additional health or fitness information for certain trips where reasonably necessary.
If you become unable to safely continue a trip due to illness, injury or fitness concerns, reasonable alternative arrangements may be considered where possible. Any additional costs may be payable by the traveller, subject to applicable law.
12. Trekking and Adventure Activities
Trekking and adventure travel involve inherent risks that cannot always be eliminated.
These may include:
- Falls and injuries;
- Altitude sickness;
- Extreme weather;
- Difficult or uneven terrain;
- Road and transportation risks;
- Remote locations;
- Limited access to medical facilities;
- Natural hazards;
- Flight disruptions;
- Changes in weather and trail conditions; and
- Other risks associated with outdoor and adventure travel.
By booking a trekking or adventure trip, you acknowledge these inherent risks and agree to follow reasonable instructions from your guide, local authorities and service providers.
13. Flights and Transportation
International flights are generally not included unless specifically stated in your itinerary or booking confirmation.
Travellers are responsible for arranging international flights unless Travel Umpire has agreed in writing to arrange them on their behalf.
Domestic flights within Nepal are included only where specifically stated in the itinerary.
Flight schedules in Nepal, particularly flights to and from mountain regions, may be affected by weather, visibility, aircraft availability, operational conditions and other circumstances beyond our control.
Travellers should allow sufficient flexibility in their travel plans for possible flight delays or cancellations.
14. Trip Disruptions and Flight Delays
Weather conditions in the Himalayas and other parts of Nepal can change rapidly and may affect flights, roads, trekking routes and other travel arrangements.
Flights to and from mountain destinations may be delayed or cancelled because of weather, visibility, operational restrictions or other circumstances.
If a flight is delayed or cancelled, Travel Umpire will make reasonable efforts to arrange the next available suitable flight or alternative transportation where possible.
However, replacement flights, helicopter services, accommodation, meals or other transportation are subject to availability and may result in additional costs.
Where an itinerary must be changed because of circumstances beyond our reasonable control, we will make reasonable efforts to provide a suitable alternative.
15. Itinerary Changes
Travel Umpire reserves the right to make reasonable changes to an itinerary where necessary due to circumstances beyond our reasonable control.
These may include:
- Weather conditions;
- Road or trail closures;
- Flight delays or cancellations;
- Natural disasters;
- Earthquakes;
- Government restrictions;
- Political situations;
- Safety concerns;
- Local conditions;
- Changes by airlines or other suppliers; or
- Other unforeseen circumstances.
We will make reasonable efforts to provide a suitable alternative itinerary, activity, accommodation or transportation where the original arrangement cannot be provided.
The safety of travellers, guides, porters and other staff will take priority over following the original itinerary exactly.
16. Accommodation
Accommodation will be provided as specified in your itinerary or booking confirmation.
If the specified accommodation becomes unavailable due to circumstances beyond our reasonable control, Travel Umpire may arrange alternative accommodation of a similar standard where reasonably possible.
Accommodation before the official start date or after the official end date of your trip is not included unless specifically stated in your booking.
Any additional accommodation requested by the traveller will normally be at the traveller’s own cost.
17. Trip Inclusions
The exact inclusions of your trip will be stated in the relevant itinerary and booking confirmation.
Depending on the trip, inclusions may include:
- Accommodation specified in the itinerary;
- Transportation within Nepal as specified;
- Domestic flights where specifically included;
- Meals specifically stated in the itinerary;
- Sightseeing and entrance fees specifically listed;
- Trekking permits and required fees;
- Guides and trekking support;
- Porters where specifically stated;
- Airport or other transfers where specified;
- Activities specifically included in the itinerary; and
- Other services specifically stated in your booking confirmation.
Where meals are included:
B = Breakfast | L = Lunch | D = Dinner
Only services specifically stated as included in your itinerary or booking confirmation are included in the trip price.
18. Trip Exclusions
Unless specifically stated otherwise, the following are generally excluded:
- International flights;
- Travel insurance;
- Nepal visa or entry fees;
- Personal expenses;
- Beverages and additional drinking water;
- Meals not specified in the itinerary;
- Accommodation before or after the stated trip dates;
- Personal trekking equipment and clothing;
- Medical expenses;
- Emergency evacuation costs;
- Tips and gratuities not specifically included;
- Additional transportation caused by personal changes;
- Costs resulting from flight delays or cancellations outside our reasonable control; and
- Any service not specifically stated as included.
The exact inclusions and exclusions applicable to your trip will be confirmed at the time of booking.
19. Third-Party Suppliers
Travel Umpire may use independent third-party suppliers for flights, accommodation, transportation, activities, guides, porters and other services.
We will make reasonable efforts to work with suitable and reliable suppliers.
However, third-party services may be subject to their own terms, conditions, operating requirements and limitations.
Where a third-party service cannot be provided because of circumstances outside our reasonable control, we will make reasonable efforts to arrange an appropriate alternative where possible.
20. Additional Costs Caused by Disruptions
Where a disruption is caused by circumstances outside Travel Umpire’s reasonable control, additional costs may arise for accommodation, meals, transportation, flights, helicopter services, permits or other arrangements.
Unless otherwise agreed in writing or required by applicable law, these additional costs may be payable by the traveller.
This is one of the reasons we strongly recommend comprehensive travel insurance covering trip disruption, cancellation and emergency evacuation.
21. Traveller Responsibilities
Travellers agree to:
- Follow all applicable local laws and regulations;
- Respect Nepalese culture, traditions, communities and the environment;
- Follow reasonable instructions provided by guides, staff and local authorities;
- Provide accurate information required for the booking;
- Arrive at agreed meeting points and departure times;
- Respect guides, porters, drivers, accommodation staff and other travellers;
- Take reasonable care of accommodation, equipment and other property provided during the trip; and
- Behave in a manner that does not create a serious safety risk to themselves or others.
Travel Umpire reserves the right to take reasonable action, including removing a traveller from a trip, where their behaviour creates a serious safety risk or significantly affects other travellers.
Any resulting costs may be the responsibility of the traveller, subject to applicable law.
22. Personal Belongings
Travellers are responsible for their passports, money, luggage, valuables, electronic devices and personal belongings.
Travel Umpire is not responsible for loss, theft or damage to personal belongings except where liability cannot legally be excluded.
We strongly recommend keeping important documents, money and valuables secure and obtaining appropriate travel insurance.
23. Force Majeure
Travel Umpire will not be responsible for failure, delay or changes to services caused by circumstances beyond our reasonable control.
These may include:
- Natural disasters;
- Earthquakes;
- Extreme weather;
- Pandemics or public health emergencies;
- War;
- Civil unrest;
- Government restrictions;
- Strikes;
- Road closures;
- Flight disruptions;
- Natural hazards; or
- Other unforeseen circumstances.
In such circumstances, Travel Umpire will make reasonable efforts to assist travellers and provide suitable alternatives where possible.
24. Complaints
If you experience a problem during your trip, please inform your Travel Umpire guide or representative as soon as reasonably possible.
Providing us with an opportunity to address the issue during the trip may allow us to resolve the matter promptly.
If the matter cannot be resolved during the trip, you should submit your complaint to Travel Umpire in writing as soon as reasonably possible after completing your trip.
25. Privacy
Personal information provided to Travel Umpire during the booking process will be handled in accordance with our Privacy Policy.
We may use information provided by you where reasonably necessary to process your booking, arrange travel services, communicate with you and provide the services you have requested.
26. Changes to These Terms & Conditions
Travel Umpire reserves the right to update or amend these Booking Terms & Conditions from time to time.
The Terms & Conditions applicable to your booking will generally be those accepted by you at the time of booking, unless a change is required by law or otherwise agreed with you.
The latest version of these Terms & Conditions will be made available on the Travel Umpire website.
27. Acceptance of Terms
By submitting a booking request, paying a deposit, making a payment or confirming participation in a Travel Umpire trip, you confirm that you:
- Have read and understood these Booking Terms & Conditions;
- Have had the opportunity to ask questions regarding your booking;
- Accept the applicable payment, cancellation and refund conditions;
- Understand the nature and risks of the activities included in your trip;
- Accept responsibility for obtaining appropriate travel insurance and required travel documents; and
- Agree to comply with these Booking Terms & Conditions.
